What it’s not is the rumored Presidential order halting deportations. The directive is really an outline for Immigration Customs Enforcement agents in handling the detention of undocumented or deportable individuals with children. The directive essentially directs agents to consider the needs of the child or children when a parent is detained including the parent’s desire of where and with who the child should be placed. The directive does mention that agents should also consider prosecutorial discretion with parents, but in my opinion the discussion of discretion is really no different than the Obama 2011 announcement regarding discretion and prioritizing deportations of individuals with criminal history. So not bad news, and probably good news, but not groundbreaking news. For now we still await Congress’ return this coming weak and see and hope that the Budget crises and Syria don’t side track Immigration Reform.
