PRESIDENT OBAMA’S EXECUTIVE ACTION

NEW EXECUTIVE ACTION:

President Obama’s new executive action includes several components designed to help undocumented families.

Expanded DACA: Executive action has expanded the current Deferred Action, “DACA” program by allowing anyone who entered the United States, prior to January 1, 2010, while under the age of 16, to apply. You must not have left the United States after January 1, 2010 and you must have no disqualifying crimes.

Deferred Action for Parents: There will also be a new version of Deferred Action for Parents of Legal Permanent Residents or United States Citizens. To qualify for this benefit you must:

1. Have a child who is a U.S. citizen or permanent resident children; and;

2. Prove that you entered the United States before January 1, 2010; and

3. Prove that you have no disqualifying crimes. We are awaiting further guidance on what a disqualifying crime is.

Expanded family member for provisional 601A waivers: Under the current program spouses of US Citizens are allowed to apply for the ten year bar waiver without first having to leave the United States. This reduces the length of time the family must remain out of the country waiting for a decision on the waiver. With Obama’s expansion to this program, spouses and children of lawful permanent residents, as well as the adult children of U.S. citizens and lawful permanent residents are now included. Immigration is also directed to further clarify the “extreme hardship”.

There will be forthcoming guidance and regulations regarding provisions extending benefits to temporary workers, entrepreneurs and high skilled workers.
